• Code, configs, diffs, deployment metadata, deployment artifacts, and related materials you submit to or process through the service

• Technical information such as IP address, browser type, device identifiers, network information, and approximate geolocation inferred from those signals

3. How We Use Your Data

We use collected data to:

• Provide, host, operate, schedule, and secure the service
• Support deployments, workflows, wallets, and integrations
• Debug issues, analyze usage patterns, and improve reliability
• Detect abuse, fraud, unauthorized access, sanctions or restricted region issues, and other security or compliance risks
• Provide support and communicate with you about the service
• Train, fine-tune, evaluate, and improve AI systems as described below and where permitted by law

4. AI Features and Training Use

When you use OpenPond AI features, including chat, code generation, code editing, code review, deployment assistance, workflow generation, scheduling, or agent configuration, we may use prompts, chat logs, instructions, code, configs, diffs, deployment artifacts, logs, tool inputs, tool outputs, feedback, and model outputs to operate, provide, maintain, improve, evaluate, fine-tune, and train OpenPond's AI systems and related services, where permitted by law.

This also applies to code, deployment artifacts, configs, logs, and related materials that are generated, modified, analyzed, or otherwise processed through OpenPond AI features, including AI-assisted build or deploy flows and agent workflows.

If you upload or host your own code or materials in OpenPond without using OpenPond AI features to generate, modify, or analyze them, we may still process those materials to host, secure, troubleshoot, and operate the service, but this Privacy Policy does not by itself mean that non-AI-processed code is used for model training.

5. Data Storage, Processing, and Disclosure

We store and process data to operate the service. Some information may be stored locally on your device, while other data is processed on our systems or by third-party providers.

We may disclose information to service providers and infrastructure partners that help us operate the service, including cloud providers, analytics providers, AI model providers, wallet providers, exchanges, and security or compliance vendors, subject to their own terms and policies.

We may also disclose information where necessary to comply with law, enforce our terms, protect OpenPond, users, third parties, or the public, or respond to security, fraud, or abuse incidents.

6. Access to Customer Lambdas and Secrets

OpenPond systems may host, schedule, invoke, route traffic to, and process operational metadata and service telemetry associated with your deployment worker lambdas and customer lambdas as part of providing the service.

OpenPond personnel do not intentionally access the contents of your customer lambdas, source code, secrets, API keys, or wallet credentials unless you expressly request or authorize access, or access is required by law, security incident response, or platform integrity needs.

7. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect your information. No method of transmission or storage is completely secure.

8. Your Rights and Choices

Depending on your location, you may have the right to:

• Access your personal data
• Request deletion of your data
• Opt-out of certain data collection where available
• Export your data
